Nevada Supreme Court

Kelley v. Kelley

September 28, 2023

Summary

The Nevada Supreme Court held that when parents sharing court-ordered joint legal custody disagree about a medical decision, the district court must resolve the conflict by determining the child's best interest rather than applying a medically necessary standard. It adopted nonexhaustive medical-decision factors and concluded that the district court properly found COVID-19 vaccination to be in the child's best interest. The court therefore affirmed the order granting the father sole legal custody for the limited purpose of obtaining the vaccination.
