Nevada Supreme Court
In re Estate of Sweet
October 20, 20222022 NV 68
Summary
The court affirmed admission of Marilyn Sweet’s Portuguese will to probate and held that Portugal’s law determines who qualifies as an authorized person for an international will executed there. It further held that a will failing to satisfy the Uniform International Wills Act may nevertheless be probated as a foreign will under Nevada law, and that the will’s universal-heir language, construed against intestacy, devised the decedent’s entire estate. The court also held that the appellant was not entitled to a will contest because she failed to initiate one in the manner required by statute.
