Summary

The Nevada Supreme Court held that assigning the proceeds of a legal malpractice claim to an adversary in the underlying litigation is prohibited as a matter of public policy, and therefore the district court correctly invalidated such an assignment. The Court also held that an invalid assignment does not, by itself, extinguish the client’s right to pursue the malpractice claim, reversing the district court’s summary judgment on that issue and remanding for further proceedings.
