Summary

The Nevada Supreme Court held that a legal-malpractice claim or its proceeds may not be assigned to an adversary in the litigation that gave rise to the alleged malpractice because such an assignment creates risks of collusion and turns the malpractice claim into a settlement bargaining chip. The court affirmed the invalidation of the assignment but reversed summary judgment insofar as it barred the injured client from pursuing the malpractice claim after the assignment was set aside. The matter was remanded for further proceedings.
