Summary
The Nebraska Supreme Court held that neither a final judgment nor a final order existed from which an appeal could be taken. Because the case involved unresolved counterclaims, the district court had not certified a final judgment, and the counterclaims were voluntarily dismissed without prejudice, appellate jurisdiction could not be created. The court therefore vacated the Court of Appeals’ decision and remanded with directions to dismiss the appeal for lack of jurisdiction.
