Summary

The court affirmed the denial of Donald Anthony’s postconviction motion. Although Anthony’s failure to include assignments of error limited appellate review to plain error, the court held that a separate, properly sworn verification filed simultaneously with the motion satisfied the statutory verification requirement. The court nevertheless found no plain error in the district court’s alternative conclusion that Anthony’s claim lacked supporting facts and did not warrant an evidentiary hearing.
