Nebraska Supreme Court
Hastreiter v. Foltz Bros.
May 22, 2026321 Neb. 469
Summary
The court affirmed the denial of Kristine Hastreiter’s claim for workers’ compensation death benefits. Assuming without deciding that an injury preventing cancer treatment could support death benefits, the court held that Hastreiter failed to prove by sufficiently definite expert testimony that the work injury proximately caused Thomas Hastreiter to live less time than he otherwise would have. The compensation court was entitled to reject or discount the experts’ equivocal opinions and was not clearly wrong in finding causation unproven.
