Nebraska Supreme Court
State v. Nelson
February 28, 2025318 Neb. 484
Summary
The court held that when multiple prison sentences are imposed contemporaneously, whether consecutive or concurrent, all available presentence-incarceration credit must be applied only once against the aggregate of all terms imposed. Because Nelson had 241 days of credit and the sentencing orders did not accurately reflect that the credit applied to the aggregate of both concurrent sentences, the court modified one sentencing order and otherwise affirmed. The court reviewed both entitlement to credit and statutory interpretation independently.
