Summary

The Nebraska Supreme Court held that it had jurisdiction to review the district court’s judgment and that the NRD’s 2021 findings were not final, appealable orders because the board reserved penalties for a later hearing. It further held that the 2020 combination of prosecutorial and adjudicative functions did not constitutionally taint the later 2021 and 2022 hearings, which provided a new hearing without the challenged participation. The court therefore reversed and remanded for the district court to address the Hauxwells’ remaining claims. No separate opinions were filed.
