Summary

The court affirmed most of the modification order, including the denial of Joshua’s motion for a new trial and the modifications affecting the two sons. It held that Joshua received constitutionally sufficient notice through counsel, that the evidence established a material change in circumstances, and that the district court unlawfully delegated its visitation authority by making all parenting time with the daughters subject to Emily’s sole discretion. The court reversed and remanded the daughter-visitation provisions for creation of a reasonable plan serving their best interests.
