Summary
The court affirmed Brown’s theft conviction because the evidence, viewed favorably to the prosecution, permitted a rational jury to find that he intended to deprive Menards of the scissor lifts. It vacated Brown’s sentence because a Class IIA felony sentence may not combine a determinate jail term with subsequent probation and remanded for resentencing. The court declined to decide the restitution challenge because the restitution order was part of the invalid sentence and found the remaining ineffective-assistance claims either insufficiently developed for direct review or meritless on the existing record.
