Continental Resources v. Fair

Summary

The court held that Fair plausibly established a protected property interest in the value of his property exceeding his tax debt and that the tax-deed process could constitute a taking without just compensation. It affirmed summary judgment rejecting Fair's private-use, excessive-fines, due-process, and other constitutional claims, but reversed summary judgment on the just-compensation claim because genuine factual issues remained and concluded that Continental, rather than the county, could be liable.
