Montana Supreme Court
State v. N. Hunt
June 17, 20252025 MT 122
Summary
The court upheld the extension of the traffic stop and canine sniff because the officer’s specific information about drug trafficking at the defendant’s apartment, combined with the vehicle’s recent presence there and the defendant’s appearance and conduct, established particularized suspicion under the totality of the circumstances. The court nevertheless held that the State improperly introduced prior-bad-acts evidence through a rebuttal witness after eliciting the defendant’s categorical denial of selling drugs. Because that evidence created a reasonable probability of contributing to the conviction, the judgment was reversed and the case remanded for a new trial.
