Montana Supreme Court

Matters of I.d., T.d., and L.d., Yinc

December 29, 20252025 MT 299

Summary

The Court affirmed the guardianship of I.D., T.D., and L.D., holding that substantial evidence supported findings that the Department made reasonable reunification efforts and that further efforts would likely be unproductive. It also held that guardianship does not require a separate finding that a parent is unfit and that the governing statutes do not impose a clear-and-convincing-evidence burden. The Court concluded that the District Court properly determined that guardianship served the children’s best interests.
