Summary

The Court held that the probate court lacked subject matter jurisdiction to adjudicate the Land Trust’s equitable-ownership claim concerning the Sanders County Property because the claim sought equitable relief and a determination of title to property held by the estate. It therefore reversed that portion of the judgment and remanded with instructions to dismiss the Land Trust Petition. The Court affirmed the determination that Rosemary’s Will validly devised Gretchen a life estate in the property.
