Montana Supreme Court
Butte v. Butte Police
December 3, 2024419 Mont. 217
Summary
The Court held that the arbitrator's award reinstating a police officer and requiring further evaluation and rehabilitation was plausibly based on the collective bargaining agreement and did not manifestly disregard Montana law or violate public policy. The District Court therefore properly declined to vacate the award, but exceeded its statutory authority by remanding the matter to the arbitrator to reconcile the award with later evidence. The Court reversed that remand and directed confirmation of the original award.
