Summary

The Montana Supreme Court held that the District Court lacked personal jurisdiction to modify the parties' dissolution decree because the motion sought new and additional relief and was not personally served on Ingeborg as required for service of summons. Service on her South Carolina attorney was insufficient because the attorney was not counsel of record in the Montana proceeding. The court therefore reversed and vacated the modification order.
