Supreme Court of Missouri

Jenette Konopasek v. Douglas and Laura Konopasek

June 27, 2023

Summary

The Court held that Jenette’s petition adequately stated claims under the Uniform Fraudulent Transfers Act because it alleged that Douglas, her judgment debtor, transferred settlement proceeds into a tenancy-by-the-entirety account with actual intent to hinder, delay, or defraud her and without reasonably equivalent value while insolvent or becoming insolvent. The Court further held that the dismissal without prejudice was a final, appealable judgment because it practically terminated the litigation in its pleaded form. The judgment was reversed and the case remanded.
