Supreme Court of Missouri
State of Missouri v. Gary Andrews, Jr.
March 15, 2022
Summary
The Court held that the Double Jeopardy Clause does not bar the State from prosecuting a defendant for multiple offenses charged in a single proceeding merely because the defendant has pleaded guilty to one of them. Because Andrews pleaded guilty to unlawful use of a weapon while possessing a controlled substance but had not been tried or sentenced on the separate possession count, dismissing that count on double jeopardy grounds was erroneous. The judgment was reversed and the case remanded.
