Summary

The Court affirmed the Commission’s denial of workers’ compensation benefits for injuries Employee sustained when she was accidentally tripped at a medical provider’s office after a workplace insecticide exposure. The Court held that but-for causation and the fact that the exposure led Employee to the office were insufficient because accidental tripping was a risk unrelated to employment to which she was equally exposed outside work. Because the trip did not arise out of and in the course of employment, the Second Injury Fund was not implicated.
