Mississippi Supreme Court
Larry L. Stuart a/k/a Larry Stuart v. State of Mississippi
August 17, 2023
Summary
The court affirmed Stuart’s conviction and sentence for filming a person without her knowledge in a place where she had an expectation of privacy. It held that Stuart was not denied counsel because advisory counsel provided substantial procedural and substantive assistance through hybrid representation. It also held that the trial court properly denied an accident instruction because, although the instruction stated the law and was not otherwise covered, Stuart presented no evidentiary foundation that the recording itself was accidental.
