The Supreme Court of Minnesota held that Minnesota Statutes §169A.20, subd. 2(2) does not require the State to prove that the arresting officer had probable cause that the defendant was driving, operating, or in physical control of a motor vehicle while impaired when the defendant is charged with refusing a blood or urine test required by a search warrant. The Court affirmed the Court of Appeals’ judgment affirming the conviction.
