Summary

The court held that an employee may directly seek workers’ compensation payment for medical expenses arising from a compensable work injury even when a health insurer paid those expenses before compensability was determined. The employee’s direct substantive right is distinct from the health insurer’s procedural right to intervene, so the insurer’s untimely intervention extinguished its independent intervenor interest but did not eliminate the employee’s claim. The court therefore affirmed in part, reversed in part, reinstated the compensation judge’s order, and directed reimbursement to the health insurer.
