Supreme Court of Minnesota
Robert John Kaiser v. State of Minnesota
March 13, 2024
Summary
The court affirmed the grant of postconviction relief and a new trial because the State’s experts presented as medical fact that macular schisis could result only from abusive head trauma, and the State’s own expert later admitted that proposition was incorrect. The court held that the Larrison framework governs this type of false expert testimony and that Kaiser satisfied its requirements. The court did not decide Kaiser’s ineffective-assistance claim because the false-testimony ground independently supported a new trial.
