Summary

The court held that the two-tier conditional-release provision for child-pornography offenses is unambiguous and requires a 10-year term when, at the time of sentencing, the defendant has an earlier qualifying conviction. Because Overweg had been convicted of second-degree criminal sexual conduct before the court imposed sentence for the child-pornography offense, the district court properly imposed the 10-year term. The court therefore reversed the court of appeals.
