Summary

The court held that the school was not categorically immune from liability for injuries to members of the public caused by a student's driving and that the evidence could support a finding that the school assumed supervision and control over the team's trip. Because reasonable fact-finders could also conclude that the school's conduct created a foreseeable risk of injury, summary judgment on duty was improper. Justice Anderson, joined by Chief Justice Gildea, dissented, concluding that the school owed no duty as a matter of law and that the majority expanded school liability without a limiting principle.
