Summary
The Michigan Supreme Court held that a 180-day limitations provision in a boilerplate, nonnegotiated employment agreement must be reviewed for reasonableness and may also be invalidated as procedurally and substantively unconscionable. The Court determined that the employee's agreement was adhesive, but the existing record was insufficient to decide whether the shortened period was reasonable or unconscionable. The Court therefore reversed and remanded for factual development and further proceedings.
