Summary
The Michigan Supreme Court held that no compensable taking occurs when a foreclosing governmental unit complies with the statutory requirements and offers foreclosed property at a public auction but the property does not sell. The failed auction conclusively establishes that the government did not obtain property worth more than the delinquent taxes and permissible costs, so the owner is not entitled to compensation. The Court reversed the Court of Appeals and reinstated summary disposition for defendants.
