Summary

The Michigan Supreme Court held that Warren's Medical Marihuana Review Committee was a public body subject to the Open Meetings Act because the ordinance empowered it to perform the governmental function of scoring applications and, in practice, it ranked applicants and effectively selected the licensees. Although the city council formally retained final approval authority, it adopted the committee's rankings without independently considering the applications, making the committee's work functionally dispositive. The court reversed the Court of Appeals and remanded for consideration of whether the later open meetings cured the OMA violations and for other preserved issues.
