Summary

The Michigan Supreme Court held that applying the 2021 Sex Offenders Registration Act to offenders whose crimes lacked a sexual component constitutes cruel or unusual punishment under the Michigan Constitution. Although the statute was enacted as a civil public-safety regulation and rationally relates to that purpose, its cumulative restraints, stigma, supervision, and collateral consequences are punitive and grossly disproportionate when imposed on nonsexual offenders. The court affirmed removal of the defendant and similarly situated nonsexual offenders from the registry while limiting the holding to that class.
