Summary

The Michigan Supreme Court held that a condominium co-owner may maintain a premises-liability action against the condominium association for injuries sustained in a common area when the association has possession and control of that area under the governing documents. Because the co-owner surrendered control of the common elements to the association and paid the association to maintain them, the co-owner was an invitee owed a duty of reasonable care. The Court reversed the Court of Appeals and remanded for further proceedings.
