Michigan Supreme Court
Willie Griffin v. Trumbull Insurance Company
July 15, 2022
Summary
The Court held that Trumbull could be liable for Griffin's PIP benefits because the higher-priority insurer was unidentifiable before the limitations period expired, and Griffin had exercised due diligence by pursuing every insurer identifiable from the available information. Trumbull's failure to pay or deny the claim before the limitations period expired did not permit it to avoid liability by later identifying a higher-priority insurer during litigation. The Court reversed the judgment insofar as it granted summary disposition to Trumbull and remanded for further proceedings.
