Summary

The Court held that a prevailing farm or farm operation that requests relief under MCL 286.473b is entitled to its reasonably incurred costs and expenses and reasonable and actual attorney fees. The word “may” gives the prevailing farm discretion to request recovery, not the trial court discretion to deny an award; the court may determine only the amounts reasonably incurred. The Court reversed and remanded for that determination.
