The Michigan Supreme Court held that under MCL 286.473b a prevailing farm or farm operation is entitled to recover the actual costs, expenses, and reasonable attorney fees it incurs in defending a nuisance action when it requests them, and that the trial court’s discretion is limited to determining the amount of the award. The Court reversed the Court of Appeals and remanded for the district court to calculate the appropriate award.
