Summary

The Court held that when a prosecutor seeks juvenile life without parole under Michigan's discretionary sentencing statute, the prosecutor must overcome a presumption that life without parole is disproportionate by clear and convincing evidence. Because the trial court resentenced defendant without applying that framework, defendant was entitled to resentencing, but the Court first remanded to the Court of Appeals to address an unresolved constitutional challenge to the sentence. The Court did not decide whether defendant's sentence was unconstitutional as applied to his felony-murder conviction as an aider and abettor.
