Summary
The Court held that Livingston County was a proper venue for prosecuting defendant under an aiding-and-abetting theory because the alleged principal committed the delivery there, and the aiding-and-abetting statute permits prosecution as if the accomplice had directly committed the offense. The Court further held that any challenge to probable cause supporting the aiding-and-abetting charge must be raised by a motion to quash the bindover, not as a venue challenge, and that the prosecution need not prove defendant knew where the offense would occur. The judgment affirming the denial of defendant's motion to dismiss was affirmed.
