Michigan Supreme Court

Mecosta County Medical Center v. Metropolitan Group Property

June 10, 2022

Summary

The Michigan Supreme Court held that medical providers who received an assignment of an insured's right to seek no-fault benefits were not bound by a judgment entered against the assignor after the assignment. Because the providers were neither parties nor privies to that later judgment, neither res judicata nor collateral estoppel barred their assigned claims. The Court affirmed the Court of Appeals and remanded for further proceedings.
