Summary
The Court held that the proposed claim based on a nurse's failure to follow an internal standing order sounded in medical malpractice because determining whether the physician should have been notified required specialized medical knowledge. The standing order could not itself establish the medical-malpractice standard of care, so the proposed claim premised solely on its violation failed. The Court nevertheless held that the order could be admissible as evidence relevant to the standard of care if it satisfied ordinary evidentiary requirements and the jury was instructed that it did not itself establish that standard.
