Summary
The court held that the proposed claim based on a nurse's failure to follow a standing order sounded in medical malpractice because determining whether the physician should have been notified required specialized medical judgment. The standing order could not itself establish the medical-malpractice standard of care, so a claim based solely on its violation failed. The order was not categorically inadmissible, however, and could be used as evidence bearing on the standard of care if otherwise admissible and accompanied by an appropriate jury instruction.
