Summary
The Michigan Supreme Court held that fingerprinting a person’s body under the Grand Rapids Police Department’s photograph-and-print policy is a Fourth Amendment search under the trespass doctrine. Because the policy authorized warrantless fingerprinting based only on reasonable suspicion and the searches exceeded the permissible scope and duration of the investigative stops, the policy was facially unconstitutional. The court reversed and remanded Johnson’s case to the circuit court and Harrison’s case to the Court of Appeals for a determination whether Harrison voluntarily consented.
