Summary

The Michigan Supreme Court held that the tax-credit-cap provision in the agreement between the Michigan Economic Development Corporation and General Motors related to financial or proprietary information and therefore initially fit the statutory FOIA exemption. But the agreement also fell within the statutory exception for agreements to which the Michigan Strategic Fund is a party, requiring disclosure of the agreement, including the unredacted tax-credit cap. The Court reversed the Court of Appeals and remanded to the Court of Claims.
