Michigan Supreme Court

People of Michigan v. Nicholas Scott Reynolds

December 7, 2021

Summary

The court held that when a defendant has multiple concurrent convictions within the highest applicable crime class, the presentence investigation report must include separate guideline calculations for each offense, and the defendant must be sentenced using each offense's respective range. Because the trial court used only the range calculated for the third-degree criminal-sexual-conduct conviction and the record did not establish that the error was harmless, the court ordered correction of the report and resentencing on the child-sexually-abusive-activity convictions.
