Summary

The Court held that a contractual indemnification provision requiring a negligent vendor to reimburse a no-fault insurer or self-insurer for mandatory benefits paid on account of the vendor's negligence is enforceable. The provision did not affect the availability of insurance, the payment of benefits, or the relationship between the insurer and its insureds, and the statutory reimbursement mechanisms were not exclusive. The Court therefore reversed the Court of Appeals.
