Summary
The Michigan Supreme Court held that a no-fault insurance policy may limit mandatory benefits only through defenses authorized by the no-fault act or by unabrogated common law. Meemic's broad antifraud provision was unenforceable because the alleged postprocurement misrepresentations did not support common-law rescission and the act provided no applicable fraud defense. The Court affirmed the Court of Appeals in result only, vacated its opinion, and remanded for further proceedings.
