Massachusetts Supreme Judicial Court

Hidalgo v. Watch City Construction Corp.

March 25, 2026

Summary

The court held that the Appeals Court abused its discretion by reducing Hidalgo's appellate attorney-fee award for successful anti-SLAPP work based on the relatively low value of his separate Wage Act claims. Once the hours and rates for the anti-SLAPP work were found reasonable, the lodestar amount was not properly reduced using the value of claims for which Hidalgo did not seek fees. The court reversed the reduction and affirmed the fee award as modified to $67,361.25.
