Summary

The court held that the defendant produced sufficient evidence to raise a reasonable inference that police monitoring of his Snapchat account was motivated at least in part by race. It vacated the suppression ruling and remanded for a hearing at which the Commonwealth must provide a race-neutral justification, but affirmed the denial of the motion to dismiss because the resident firearm licensing scheme was not facially unconstitutional. The court concluded that the scheme had at least constitutionally valid applications to felons and persons convicted of violent crimes.
