Massachusetts Supreme Judicial Court
Commonwealth v. Fayad F., a Juvenile
January 27, 2025
Summary
The court held that a continuance without a finding entered after a juvenile's admission to sufficient facts establishes a prior offense for purposes of determining whether a later minor misdemeanor is a first offense, so the Juvenile Court had jurisdiction over the disorderly conduct charge. It also upheld the Juvenile Court rule allowing the Commonwealth to rely on such a disposition without proving the prior offense in a separate hearing. Finally, the court concluded that the evidence was sufficient to reject self-defense and support delinquency adjudications for assault and battery and disorderly conduct.
