Summary
The court held that the juvenile's State prison sentence was lawful because the sentencing judge acted within the youthful-offender statute and adequately considered the juvenile's conduct, history, rehabilitation, and public-safety risks. It also held that a youthful offender may appeal a lawful State prison sentence to the Appellate Division because the relevant statutes require access to the same sentencing-review safeguard available to adult criminal defendants. The court therefore affirmed the resentencing order.
