Even assuming the acquisition of CSLI was unlawful, any error was harmless beyond a reasonable doubt because the police did not use the CSLI or ping data to develop evidence, locate the defendant, or secure his arrest. The court affirmed the murder conviction and denial of a new trial, but vacated the firearm conviction and remanded for a new trial because the Commonwealth had not been required to prove that the defendant lacked a firearm license.
