Massachusetts Supreme Judicial Court

Commonwealth v. Baez

July 23, 2024

Summary

The court held that the evidence was sufficient to identify the defendant as the getaway driver but insufficient to prove beyond a reasonable doubt that he knew the shooters intended a lethal attack or shared that intent. The evidence was likewise insufficient to prove that he knew the shooters were armed with firearms or shared their intent to use them in the assault. The court reversed the convictions, set aside the verdicts, and remanded for entry of required findings of not guilty.
